By accessing or using the MediaPostAI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and MediaPostAI ("we", "our", or "us").

2. Description of Service

MediaPostAI is an AI-powered social media marketing platform that enables users to generate content (images, videos, captions), manage business profiles, connect social media accounts, and schedule posts for automated publishing across multiple platforms including Facebook, Instagram, LinkedIn, Twitter/X, and TikTok.

3. Account Registration

  • You must be at least 16 years old to create an account.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Subscriptions & Payments

  • The Service offers free and paid subscription plans with varying features and limits.
  • Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring charges.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change applies to their account.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Generate, publish, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Distribute spam, malware, or phishing content through connected social accounts.
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
  • Use the Service to violate the terms of any connected social media platform.
  • Scrape, data-mine, or reverse-engineer any part of the Service.

6. Content Ownership & License

Your Content

You retain ownership of all content you upload or create using the Service (business profiles, media files, edited images, captions). By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service.

AI-Generated Content

Content generated by AI through our Service (images, videos, captions) is provided to you for your use. You are solely responsible for reviewing AI-generated content before publishing and ensuring it complies with applicable laws and platform policies.

Our Service

All rights, title, and interest in the Service (including software, design, trademarks, and documentation) remain our exclusive property. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.

7. Third-Party Integrations

The Service integrates with third-party platforms (Meta, LinkedIn, Twitter/X, TikTok, Stripe, AI providers). Your use of these integrations is subject to their respective terms and policies. We are not responsible for the actions, content, or practices of any third-party services.

You authorize us to act on your behalf when publishing content to your connected social media pages. You may revoke this authorization at any time by disconnecting the respective social page.

8. Service Availability & Modifications

  • We strive to maintain high availability but do not guarantee uninterrupted service.
  • We may modify, suspend, or discontinue any feature of the Service at any time.
  • Scheduled maintenance will be communicated in advance when possible.
  • We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, MediaPostAI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be accurate, appropriate, or free from errors.

11. Termination

  • You may terminate your account at any time by contacting support or using the account deletion feature.
  • We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity.
  • Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MediaPostAI operates, without regard to conflict of law provisions.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
